On February 20, 2009 LG Electronics Inc. (Seoul, Korea) filed a complaint with the ITC against the Company for infringement of
certain of their patents alleged to be related to digital camera technology. LGE is seeking a limited exclusion order preventing
importation of devices found to infringe the asserted patents. The Company intends to vigorously defend itself in this matter.
On November 17, 2008, the Company filed a complaint against Samsung Electronics Company Ltd., Samsung Electronics America
Inc., and Samsung Telecommunications America, LLC in Federal District Court in Rochester, New York, for infringement of patents
related to digital camera technology. The Company is seeking unspecified damages and other relief.
On November 17, 2008 the Company filed a complaint against LG Electronics Inc., LG Electronics USA Inc., and LG Electronics
MobileComm USA, Inc. in Federal District Court in Rochester, New York, for infringement of patents related to digital camera
technology. The Company is seeking unspecified damages and other relief.
On February 20, 2009 LG Electronics Inc. (Seoul, Korea) commenced two actions against the Company in Federal District court in
the Southern District of California for infringement of certain of their patents alleged to be related to digital camera technology. LGE
is seeking unspecified damages and other relief. The Company intends to vigorously defend itself in this matter.
On November 17, 2008, the Company commenced a lawsuit in Landgericht Düsseldorf, Germany against Samsung Electronics
GmbH for infringement of a patent related to digital camera technology. The Company is seeking unspecified damages and other
relief.
On November 20, 2008, Research in Motion Ltd. and Research in Motion Corp. (collectively “RIM”) filed a declaratory judgment
action against the Company in Federal District Court in Dallas, Texas. The suit seeks to invalidate certain Company patents related
to digital camera technology and software object linking, and seeks a determination that RIM handheld devices do not infringe such
patents. On February 17, 2009, the Company filed its answer and counterclaims for infringement of each of these same patents.
The Company and its subsidiaries are involved in various lawsuits, claims, investigations and proceedings, including commercial,
customs, employment, environmental, and health and safety matters, which are being handled and defended in the ordinary course
of business. In addition, the Company is subject to various assertions, claims, proceedings and requests for indemnification
concerning intellectual property, including patent infringement suits involving technologies that are incorporated in a broad spectrum
of the Company’s products. These matters are in various stages of investigation and litigation, and are being vigorously defended.
Although the Company does not expect that the outcome in any of these matters, individually or collectively, will have a material
adverse effect on its financial condition or results of operations, litigation is inherently unpredictable. Therefore, judgments could be
rendered or settlements entered, that could adversely affect the Company’s operating results or cash flows in a particular period.
The Company routinely assesses all of its litigation and threatened litigation as to the probability of ultimately incurring a liability, and
records its best estimate of the ultimate loss in situations where it assesses the likelihood of loss as probable.
