11. Commitments and Contingencies
Palo Verde Nuclear Generating Station
Spent Nuclear Fuel and Waste Disposal
On December 19, 2012, APS, acting on behalf of itself and the participant owners of Palo
Verde, filed a breach of contract lawsuit against the DOE in the U.S. Court of Federal Claims. The
lawsuit seeks to recover APS’s damages incurred due to DOE’s breach of the Standard Contract for
failing to accept Palo Verde spent nuclear fuel and high level waste from January 1, 2007 through
June 30, 2011, as it was required to do pursuant to the terms of the Standard Contract and the Nuclear
Waste Policy Act.
