The Buyer defaults in its obligation to take delivery of an Aircraft as provided in the Agreement.
(10)
The Buyer or any of its Affiliates defaults in the observance or performance of any other covenant,
undertaking or obligation contained in this Agreement or any other material agreement between the Buyer or
its Affiliates, on the one hand, and the Seller or its Affiliates on the other hand, provided that, if such breach or
default is capable of being cured and such breach or default is not cured within any specified cure period.

Any other event that the parties agree in writing constitutes a Termination Event.
21.2
Remedies in Event of Termination
21.2.1 If a Termination Event occurs, the Buyer will be in material breach of this Agreement, and the Seller can elect any of
the following remedies under the applicable law:
