BasedupontheCourt’sOrderdatedMarch11,2003(the“Order”),i)thejury’scompensatorydamages
awardshallbeincreasedbytheamountequaltotheinfringingrevenuesfortheperiodNovember1,2002
toNovember30,2002multipliedbytheroyaltyrate;ii)supplementaljudgmentisenteredforNTPfor
compensatorydamagesequaltotheinfringingrevenuesfortheperiodDecember1,2002to
February28,2003multipliedbytheroyaltyrate.Whetherenhancementofsaidsupplementaljudgment
iswarrantedwillbesubsequentlydetermined(seelaterinnote14inreferencetotheMay23,2003
rulings);iii)onorbeforeMarch30,2003,theCompanyshallprovidetheAccounting,dulyveriedand
sworn,toNTPandtheCourt;iv)commencingwiththerstquarterofscal2004,theCompanyshall
provideanOngoingQuarterlyAccountingtoNTPandtheCourtofallinfringingrevenues;v)toaccount
foranyongoingpostjudgmentinfringementactivity,theCompanyshallestablishaninterest-bearing
accountwithanFDIC-insuredbanklocatedintheEasternDistrictofVirginiaandmakedepositstherein
onaquarterlybasis(“QuarterlyDeposits”),inamountsequaltothequarterlyinfringingrevenues
multipliedbytheroyaltyrate.WhetherenhancementoftheQuarterlyDepositsiswarrantedwillbe
determined(seelaterinnote14inreferencetotheMay23,2003rulings);vi)theQuarterlyDepositsshall
continueuntilsuchtimeasthejudgmentofthisCourtisafrmed,reversed,orremanded,atwhich
timethepartiesshallmovetheCourtforahearingonthedispositionoftheQuarterlyDeposits;vii)the
Companyshallpayprejudgmentinterestinthecompensatory(non-enhanced)portionofdamages
awardedbythejury.SuchinterestshallaccruefromthedateoftheCompany’srstinfringingactivityand
becompoundedquarterly.Thepartiesshalljointlysubmitacalculationoftheinterestduehereunderno
laterthanMarch30,2003;viii)theCompanyshallpaypostjudgmentinterestonthefullamountofthe
monetaryawardenteredbytheCourt,asspeciedintheCourt’sentryofnaljudgment.
TheCourtdidnotruleonotherpost-trialmotionsandorderedthepartiestomediationbeforea
U.S.MagistrateJudge.Nodenitivetimeframewassetforthemediation.Asaresult,furtherrulingsand
potentialappealsareexpectedtobepostponedpendingtheoutcomeofthemediationprocess.
OnMay23,2003theCourtruledontheissuesofenhancedcompensatorydamages,plaintiff’sattorney
feesandcertainothermattersasfollows:
EnhancedCompensatoryDamages
TheCourtorderedthatNTPbeawardedcompensatorydamagessuchthatallinfringingrevenues
subsequenttothedateofthejuryverdictareenhancedbyafactorof0.5or50%.Thisincreasesthe
royaltyrateto8.55%from5.7%.InfringingrevenuesnowincludeallBlackBerryhandheld,service
andsoftwarerevenuesintheUnitedStates.TheCompanyrecordedanadditionalprovisionof$13.5
millioninthefourthquarterwithrespecttoenhancedcompensatorydamagesfortheperiodupto
March1,2003.
Plaintiff’sAttorneyFees
TheCourtorderedthatNTPbeawardedplaintiff’sattorneyfeesfortheperioduptoFebruary22,2003,
atafactorof0.8or80%ofactualfeesincurredbyNTPinthismatter.TheCompanyhasrecordedan
additionalprovisionof$5.0millioninthefourthquarterwithrespecttoestimatedplaintiff’sattorney
feesfortheperioduptoMarch1,2003.ThisprovisionissubjecttoreceiptandreviewofNTP’ssummary
ofattorneyfeesforthisperiod.
PostjudgmentInterest
TheCompanyalsorecordedadditionalpostjudgmentinterestfortheperiodNovember22,2002
toMarch1,2003toaccountfortheCourt’sawardsinthesenewrulings.
TheCourthasnotyetruledonothermatters,includingwhetherornotaninjunctionwillbegrantedtoNTP.
Giventheabove,duringthefourthquarterofscal2003,theCompanyrecordedanexpenseof
$25.5millionwithrespecttotheNTPmattertoprovideforadditionalestimatedcompensatory
damagesfortheperiodNovember1,2002toFebruary28,2003;enhancedcompensatorydamages
