14.LitigationAward
DuringNovember2001,theCompanywasservedwithacomplaintledbyNTP,Inc.(“NTP”)alleging
thattheCompanyinfringedoneightofitspatents(the“NTPmatter”).
Duringthesecondquarterofscal2003,theCompanyrecordedanexpenseof$4.9million
foritscurrentandestimatedfuturecostswithrespecttoongoinglegalfeesfortheNTPmatter.
TheNTPmatterwenttotrialduringthethirdquarterof2003intheUnitedStatesDistrictCourt
fortheEasternDistrictofVirginia(the“Court”).ThejuryissuedaverdictinfavourofNTPon
November21,2002.Specically,thejuryfoundthatcertainoftheCompany’sproductsandservices
madeavailableintheUnitedStatesovercertainperiodsinfringedonNTPpatents(the“infringing
revenues”)andasaresultthejuryawardeddamagesbaseduponitsassessmentoftheestimated
incomederivedfromtheseinfringingrevenues.Thejuryalsofoundthattheinfringementwaswilful.
Baseduponitsndingofinfringement,thejuryawardedcompensatorydamagesof$23.1million(the
“juryverdict”)baseduponitsassessmentoftheinfringingrevenuesmultipliedbyitsdetermination
ofanappropriateroyaltyrateof5.7%(the“royaltyrate”).Accordingly,duringthethirdquarterofscal
2003,theCompanyrecordedanexpenseof$23.1millionpursuanttothejuryverdict;andaswell
recordedanexpenseof$4.7millionforitscurrentandestimatedfuturecostswithrespecttoongoing
legalfeesfortheNTPmatterforatotalchargeof$27.8million.Thejury’scompensatorydamages
awardof$23.1millionremainssubjecttopost-trialmotionsandappeal.TheCourtscheduleda
hearingonFebruary28,2003toruleonvariouspost-trialmotions.
Duringthefourthquarterof2003,bothNTPandtheCompanyledpost-trialmotionsandsupporting
memorandawiththeCourtinadvanceoftheFebruary28,2003hearing.NTPledmotionsforentry
ofnaljudgment;prejudgmentandpostjudgmentinterest;enhanceddamages;attorneyfees;and
anapplicationforapermanentinjunction.TheinjunctionapplicationseekstoprohibittheCompany
fromprovidingBlackBerryserviceintheUnitedStatesandfromsellingand/ordistributingcertain
handheldsandsoftware.TheCompany’scounselled,amongstothermotions,amotionaskingthe
judgetoenterajudgmentinfavouroftheCompanyasamatteroflaw,notwithstandingthejury’s
verdict;andaswellamotionforanewtrial.
DuringthehearingonFebruary28,2003,theCourtheardargumentsinrelationtothesepost-trial
motions,butdidnotruleonanyofthemotionsexcepttwo.TheCourtruledthatNTPwasentitledto,
forthepurposesofdeterminingadditionalcompensatorydamages,anaccountingoftheCompany’s
infringingrevenuesfortheperiodNovember1,2002toFebruary28,2003(the“Accounting”).In
addition,theCourtruledthatifthejury’sverdictwereentered,theprejudgmentinterestratewould
besetattheprimerate.
