Fiscal2003ThirdQuarter
TheNTPmatterwenttotrialduringthethirdquarterof2003intheUnitedStatesDistrictCourtforthe
EasternDistrictofVirginia(the“Court”).ThejuryissuedaverdictinfavourofNTPonNovember21,2002.
Specically,thejuryfoundthatcertainoftheCompany’sproductsandservicesmadeavailableinthe
UnitedStatesovercertainperiodsinfringedonNTPpatents(the“infringingrevenues”)andasaresult
thejuryawardeddamagesbaseduponitsassessmentoftheestimatedincomederivedfromthese
infringingrevenues.Thejuryalsofoundthattheinfringementwaswillful.Baseduponitsndingof
infringement,thejuryawardedcompensatorydamagesof$23.1million(the“juryverdict”)basedupon
itsassessmentoftheinfringingrevenuesmultipliedbyitsdeterminationofanappropriateroyaltyrate
(the“royaltyrate”).
Accordingly,duringthethirdquarterofscal2003,theCompanyrecordedanexpenseof$23.1million
pursuanttothejuryverdict;andrecordedanexpenseof$4.7millionforitscurrentandestimated
futurecostswithrespecttoongoinglegalfeesfortheNTPmatterforatotalchargeof$27.8million.
Fiscal2003FourthQuarter
Duringthefourthquarterof2003,bothNTPandtheCompanyledpost-trialmotionsandsupporting
memorandawiththeCourtinadvanceofaFebruary28,2003hearing.NTPledmotionsforentryof
naljudgment;prejudgmentandpostjudgmentinterest;enhanceddamages;attorneyfees;andan
applicationforapermanentinjunction.TheinjunctionapplicationseekstoprohibittheCompanyfrom
providingBlackBerryserviceintheUnitedStatesandfromsellingand/ordistributingcertainhandhelds
andsoftware.TheCompany’scounselled,amongstothermotions,amotionaskingtheCourttoenter
ajudgmentinfavouroftheCompanyasamatteroflaw,notwithstandingthejury’sverdict.Additonally,
RIMledamotionforanewtrial.
DuringthehearingonFebruary28,2003,theCourtheardargumentsinrelationtothesepost-trial
motions,butdidnotruleonanyofthemotionsexcepttwo:i)theCourtruledthatNTPwasentitledto,
forthepurposesofdeterminingadditionalcompensatorydamages,anaccountingoftheCompany’s
infringingrevenuesfortheperiodNovember1,2002toFebruary28,2003(the“Accounting”);andii)the
Courtruledthatifthejury’sverdictwereentered,theprejudgmentinterestratewouldbesetatthe
primerate.
TheCourtnextruledonMarch11,2003asfollows:i)thejury’scompensatorydamagesawardwas
increasedbytheamountequaltotheinfringingrevenuesfortheperiodNovember1,2002to
November30,2002multipliedbytheroyaltyrate;ii)supplementaljudgmentwasenteredforNTP
forcompensatorydamagesequaltotheinfringingrevenuesfortheperiodDecember1,2002to
February28,2003multipliedbytheroyaltyrate;iii)onorbeforeMarch30,2003,theCompanywas
requiredtoprovidetheAccounting,dulyveriedandsworn,toNTPandtheCourt;iv)commencing
withtherstquarterofscal2004,theCompanywasrequiredtoprovideanOngoingQuarterly
AccountingtoNTPandtheCourtofallinfringingrevenues;v)toaccountforanyongoingpostjudg-
mentinfringementactivity,theCompanywasrequiredtoestablishaninterest-bearingaccountwith
anFDIC-insuredbanklocatedintheEasternDistrictofVirginiaandmakedepositsthereinona
quarterlybasis(“QuarterlyDeposits”),inamountsequaltothequarterlyinfringingrevenuesmultiplied
bytheroyaltyrate;vi)theQuarterlyDepositsaretobecontinueduntilsuchtimeasthejudgmentof
theCourtisafrmed,reversed,orremanded,atwhichtimethepartieswillberequiredtomovethe
CourtforahearingonthedispositionoftheQuarterlyDeposits;vii)theCompanyisrequiredtopay
prejudgmentinterestonthecompensatory(non-enhanced)portionofdamagesawardedbythejury.
SuchinterestwillaccruefromthedateoftheCompany’srstinfringingactivityandbecompounded
quarterly.ThepartiesjointlysubmittedacalculationoftheinterestdueonMarch28,2003;andviii)the
Companywillberequiredtopaypostjudgmentinterestonthefullamountofthemonetaryaward
enteredbytheCourt,asspeciedintheCourt’sentryofnaljudgment.
