longas(i)thePremisesarespecificallycovered(byrider,endorsementorotherwise),(ii)thelimitsofthepolicyareapplicableona"perlocation"
basistothePremisesandprovideforrestorationoftheaggregatelimits,and(iii)thepolicyotherwisecomplieswiththeprovisionsofthisLease.
11.6IncreasedCoverage.Upondemand,TenantshallprovideLandlord,atTenant'sexpense,withsuchincreasedamountofexistinginsurance,
andsuchotherinsuranceasLandlordortheMortgageesmayreasonablyrequire.
11.7 SufficiencyofCoverage.NeitherLandlordnoranyof Landlord'sAgents makesany representationthatthetypesofinsuranceand limits
specified to be carried by Tenant under this Lease are adequate to protect Tenant. If Tenant believes that any such insurance coverage is
insufficient,Tenantshall provide, atits own expense,such additional insuranceas Tenant deemsadequate.Nothing containedhereinshalllimit
Tenant's liability under this Lease, and Tenant's liability under any provision of this Lease, including, without limitation, under any indemnity
provisions,shallnotbelimitedtotheamountofanyinsuranceobtained.
11.8 InsuranceRequirements .Tenant's insurance (i) shall bein a form reasonablysatisfactory to Landlord and theMortgagees and shall be
carried with companies that have a "Best Key Rating Guide" rating of A/VII or better and that are determined by Landlord, in its reasonable
discretion,asfinanciallysoundonacurrentbasis,(ii)shallprovidethatsuchpoliciesshallnotbesubjecttomaterialalterationorcancellationexcept
after at least thirty (30) days prior written Notice to Landlord (provided that if such insurer is unwilling or unable in accordance with industry
standards toprovide Landlord such prior Notice, then Tenant shall provide Landlord such Notice), and (iii) shall be primary, and any insurance
carriedbyLandlordorLandlord'sAgentsshallbeexcessandnoncontributing.Tenant'spolicyorpolicies,ordulyexecutedcertificatesforthemin
the form and content acceptable to Landlord, shall be deposited with Landlord concurrently with Tenant's execution of this Lease, and prior to
renewalofsuchpolicies.IfTenantfailstoprocureandmaintaintheinsurancerequiredtobeprocuredbyTenantunderthisLease,Landlordmay,
but shall not be required to, order such insurance at Tenant's expense. All sums reasonably disbursed, deposited or incurred by Landlord in
connectiontherewith,including,butnotlimitedto,allcosts,expensesandactualattorneys'fees,shallbedueandpayablebyTenanttoLandlord,as
anitemofAdditionalRent,ondemandbyLandlord,togetherwithinterestthereonattheApplicableRatefromthedateofsuchdemanduntilpaidby
Tenant.
11.9ImpoundFunds.IfrequestedbyanyMortgageestowhomLandlordhasgrantedasecurityinterestinthePremises,orifanyEventofDefault
occursunderthisLease,Tenantshall,atLandlord'selection,payLandlord,concurrentlywitheachpaymentofMonthlyRent,asumequaltoone-
twelfth(1/12)oftheannualinsurancepremiumspayablebyTenantforallinsurancewhichTenantisrequiredtoobtainpursuanttothisArticleXI.
Suchsums(the"ImpoundFunds")shallbeheldbyLandlordandappliedtothepaymentofsuchinsurancepremiumswhendue;provided,however,
LandlordshallnotberequiredtokeeptheImpoundFundsseparatefromotherfunds,TenantshallnotbeentitledtointerestontheImpoundFunds
andnotrustrelationshipshallbecreatedwithrespecttotheImpoundFunds.TheamountoftheImpoundFundswhenunknownshallbereasonably
estimated by Landlord. If the Impound Funds paid to Landlord by Tenant under this Section 11.9 are insufficient todischarge the obligations of
Tenant to pay such insurance premiums as the same become due, Tenant shall pay to Landlord, within ten (10) days after Landlord's written
request therefor, such additionalsums necessary to pay such obligations. If an Event of Default has occurred, any balance remaining from the
ImpoundFundsmay,attheoptionofLandlord,beappliedtoanyobligationthendueunderthisLeaseinlieuof beingappliedtothepaymentof
insurancepremiums.TheunusedportionoftheImpoundFunds,ifany,shallbereturnedtoTenantwithinthirty(30)daysoftheexpirationofthis
LeaseoranyterminationofthisLeasenotresultingfromanEventofDefault,providedthatTenanthasvacatedthePremisesinthemannerrequired
bythisLease.
11.10Landlord'sDisclaimer.NotwithstandinganyotherprovisionsofthisLease,andtothefullestextentpermittedbyApplicableLaw,Landlord
and Landlord's Agents shall not be liable for any loss or damage to persons or property resulting from theft, vandalism, fire, explosion, falling
materials,glass,tileorsheetrock,steam,gas,electricity,waterorrainwhichmayleakfromanypartofthePremises,orfromthepipes,appliances
orplumbingworksthereinorfromtheroof,streetorsubsurface,orfromactsofGodorfromanyothercausewhatsoever,unlesscausedbyordue
to the sole gross negligence or willful misconduct of Landlord (provided, however, in no event shall Landlord be liable for any consequential
damages,opportunitycostsorlostprofitsincurredorsufferedbyTenant).LandlordandLandlord'sAgentsshallnotbeliableforinterferencewith
lightorair,orforanylatentdefectinthePremisesexceptasotherwiseexpresslyprovidedinthisLease.TenantshallgivepromptNoticetoLandlord
incaseofacasualty,accidentorrepairneededtothePremises.
11.11WaiverofSubrogation.Landlord,excepttotheextentTenant'sinsurancecoverslosstoLandlordplusTenant'sobligationswithrespectto
maintenanceandrepairandpaymentofinsurancedeductibleshereunder,
