numberofchemicalsontheSVHCCandidateListto28.UndertheREACHregulations,producersandimportersof
achemicalontheCandidateListwhosequantitiesintheproduced/importedarticlesareabove1metrictonin
totalperyearandinaconcentrationthatexceeds0.1%weightbyweight(w/w)willberequiredtonotifythe
EuropeanChemicalAgencywithinformationpertainingtoitsusebyJune1,2011.Garminiscurrentlygathering
informationfromitssuppliersastowhetheranyofthechemicalslistedontheJanuary2010SVHClistare
containedinanyarticlespurchasedfromsuchsuppliers.Garminiscontinuinganongoingefforttoobtain
informationnecessaryforGarmintoevaluateanypossiblenotificationresponsibilities.
AC/DCadaptersincludedasanaccessorywithcertainGarminproductsorsoldasanoptionforbattery
chargingofmanyportableGarminproductswillrequiresubmissionsofenergy‐useprofilesinaccordancewiththe
EUEuP(EnergyUsingProducts)Directive.Garminismodifyingthedesignandenergy‐useprofilesofouradapters
inordertocomplywithapplicablelawsandregulations.Additionally,theU.S.DepartmentofEnergyhas
promulgatedaregulationpertainingtoexternalpowersuppliesandcompliancewiththeenergyefficiency
standardsthatwereestablishedundertheEnergyIndependenceandSecurityActof2007.Wewillbeaddressing
theserequirementsasnecessary.
Garminproductsmayalsobecomesubjecttofurtherenergyefficiencyrequirementsifandwhenrequired
underU.S.Federalclimatechangelegislation.
InJune2009theCaliforniaAirResourcesBoardadoptedproposedregulationstoreducegreenhousegas
emissionswhichwouldbeginphasinginstartingwith2012model‐yearvehiclesthatwouldrequirevehiclessoldin
CaliforniatohavesolarreflectivewindowglazingthatmayinterferewiththereceptionofGPSsatellitesignalsby
portablenavigationdevices.
ThePeople’sRepublicofChinahasenactedlegislationwhichiswidelyknownas“ChinaRoHS”.Thefirst
phaseofChinaRoHStookeffectonMarch1,2007andrequiresthedisclosureandmarkingofcertainsubstances,
includinglead,mercury,cadmiumandhexavalentchromiumincertainelectronicproducts.Wehaveestablisheda
programinordertocomplywiththefirstphaseofChinaRoHS.
OtherstatesandcountrieshavepromulgatedorproposedlegislationsimilartotheRoHSDirectiveand/or
theWEEEDirective.Theneedforandcostofourcompliancewithsuchlegislationcannotyetbefullydetermined
butthecostcouldbesubstantial.
Severalstateshaveenactedlawspertainingtothereductionofmercuryinproductsandthelabelingof
mercury‐containingproducts,includingthememberstatesoftheInterstateMercuryEducationandReduction
Clearinghouse(IMERC).Someoftheselaws,includingthoseinConnecticut,NewYork,VermontandLouisiana,are
applicabletocertainofGarmin’sGPSproducts.Wehaveestablishedanongoingcomplianceprogramtoensure
thatwearefulfillingthenoticeandlabelingrequirementssetforthintherelevantmercurylegislation.
GarminhasimplementedmultipleEnvironmentalManagementSystem(“EMS”)policiesinaccordance
withtheInternationalOrganizationforStandardization(ISO)14001standardforEnvironmentalHealthandSafety
Management.Garmin’sEMSpoliciessetforthpractices,standards,andprocedurestoensurecompliancewith
applicableenvironmentallawsandregulationsatGarmin’sKansasheadquartersfacility,Garmin’sEuropean
headquartersfacility,andGarmin’sTaiwanmanufacturingfacility.
Regulatoryand“GreenProcurement”demandsfromourcustomersarealsoincreasing,particularlyinthe
areasofrestrictedsubstanceuseandenvironmentally‐friendlydesignandmanufactureinitiatives.Theoverall
impactsofthesecustomerrequirementscannotyetbeestablished.Garminiscommittedtoimprovingour
productsandprocessestomeetourcustomerneeds.
