OnFebruary12,2016,OG&Efiledanapplicationrequestingthe
OCCtoissueanorderapprovingtheinstallationofdryscrubbersat
theSoonerfacility,onorbeforeMay2,2016.Theapplicationstates
thatiftheapplicationisnotapprovedbyMay2,2016,OG&Ewill
decideatthattimewhethertocancelthedryscrubberequipmentand
installationcontractsandmakeplanstoconverttheSoonercoalunits
tonaturalgas.AsofDecember31,2015,OG&Ehadincurred
$94.8millionofconstructionworkinprogressonthedryscrubbers.
OG&Eestimatesanother$35.0millionofin-processexpenditureswill
beincurredpriortoMay1,2016.Additionally,iftherequestisnot
approved,OG&Eexpectstoseekrecoveryinsubsequentproceedings
fortheexpendituresincurredforthedryscrubberprojectand
reasonablestrandedcostsassociatedwiththediscontinuanceofthe
Soonercoalunits.
FuelAdjustmentClauseReviewforCalendarYear2014
OnJuly28,2015,theOCCstafffiledanapplicationtor viewOG&E’s
fueladjustmentclauseforcalendaryear2014,includingtheprudence
ofOG&E’selectricgeneration,purchasedpowerandfuelprocurement
costs.OG&Efiledthenecessa yinformationanddocumentsneededto
satisfytheOCC’sminimumfilingrequirement ulesonSeptember2,
2015.AhearingisscheduledtobeheldonApril7,2016.
IntegratedResourcePlans
InAugust2015,OG&EinitiatedtheprocesstoupdateitsIRPpursuant
totheOCCrules.AfterengaginginterestedstakeholdersinAugust
andSeptember,OG&Efinali edthe2015IRPandsubmittedittothe
OCConOctober1,2015.The2015IRPupdatedcertainassumptions
containedintheIRPsubmittedin2014,butdidnotmakeanymaterial
changestotheECPandotherpartsoftheactionplancontainedinthe
IRPsubmittedin2014.
OklahomaRateCaseFiling
OnDecember18,2015,OG&Efiledagene alratecasewiththeOCC
requestingarateincreaseof$92.5millionanda10.25percentreturn
onequitybasedonaJune30,2015testyear.OG&Eprimarilyseeks
torecover$1.6billionofelectricinfrastructureadditionssinceitslast
generalratecaseinOklahoma,theimpactoftheexpirationofOG&E’s
wholesalecontractsandincreasedoperatingcostssuchasvegetation
management.

InJuly2012,OG&EfiledanapplicationwiththeOCCtorec ver
certaincostsassociatedwithDemandProgramsthroughtheDemand
ProgramRider,includingthelostrevenuesassociatedwiththe
SmartHoursprogram.TheSmartHoursprogramisdesignedto
incentivizeparticipatingcustomerstoreduceon-peakusageorshift
usagetooff-peakhoursduringthemonthsofMaythroughOctober,by
offeringlowerratestothosecustomersintheoff-peakhoursofthose
months.Lostrevenuesarecreatedbythedifferenceinthestandard
ratesandthelowerincentivizedrates.Non-SmartHoursprogram
customersbenefitfromthereductionofon-peakusage ySmartHours
customersbythereductionofmorecostlyon-peakgenerationandthe
delayinaddingnewon-peakgeneration.
InDecember2012,theOCCissuedanorderapprovingtherecovery
ofcostsassociatedwiththeDemandPrograms,includingthelost
revenuesassociatedwiththeSmartHoursprogram,subjecttothe
OklahomaPUDstaffreview.
InMarch2014,theOklahomaPUDstaffbegantheirreviewofthe
DemandProgramcost,includingthelostrevenuesassociatedwiththe
SmartHoursprogram.InNovember2014,OG&Ebelievedthatithad
reachedanagreementwiththeOklahomaPUDstaffonthe
methodologytobeusedtocalculatelostrevenuesassociatedwiththe
SmartHoursprogramandtheamountoflostrevenuefor2013,which
totaled$10.1million.Theagreementalsoincludedutilizingthesame
methodologyforcalculatinglostrevenuesfor2014,whichresultedin
lostrevenuesfor2014of$11.6million.
InJanuary2015,OG&Eimplementedratesthatbeganrecovering
the2013lostrevenues,inaccordancewiththeagreementthatit
believedhadbeenreachedwiththeOklahomaPUDstaff.
InApril2015,theOklahomaPUDstafffiledanapplication,seeking
anorderfromtheOCC,fordeterminingthepropermethodologyfor
calculatinglostrevenuespursuanttoOG&E’sDemandProgramRider,
primarilyaffectingtheSmartHoursprogramlostrevenues.Inthe
application,theOklahomaPUDstaffrecommendstheOCCapprove
theOklahomaPUDstaffmethodologyforcalculatinglostrevenues
associatedwiththeSmartHoursprogram,whichdiffersfromthe
methodologythatOG&Ebelievesitagreeduponandwhichwould
resultinrecoveryoflostrevenuefor2013of$4.9million,areduction
of$5.2millionfromtheamountrecordedbyOG&Efor2013.
OG&EbelievesthemethodologyagreedtoinNovember2014is
consistentwiththe2012OCCorderanditisprobablethatOG&Ewill
recoverthe$10.1millionoflostrevenuesassociatedwith2013,the
$11.6millionassociatedwith2014andthe$14.9millionassociated
with2015.AhearingwasheldonJune30,2015andJuly1,2015.
OG&EisunabletopredictwhenitwillreceivearulingfromtheOCC.
EnvironmentalCompliancePlan
OnAugust6,2014,OG&EfiledanapplicationwiththeOCC or
approvalofitsplantocomplywiththeEPA’sMATSandRegionalHaze
FIPwhileservingthebestlong-terminterestsofcustomersinlightof
futureenvironmentaluncertainties.Theapplicationsoughtapprovalof
theECPandforarecoverymechanismfortheassociatedcosts.The
ECPincludesinstallingdryscrubbersatSoonerUnits1and2andthe
conversionofMuskogeeUnits4and5tonaturalgas.Theapplication
alsoaskstheOCCtopredeterminetheprudenceofitsMustang
ModernizationPlanwhichcallsforreplacingOG&E’ssoon-to-beretired
Mustangsteamturbinesinlate2017with400MWsofnew,efficient
combustionturbinesattheMustangsitein2018and2019and
approvalforarecoverymechanismfortheassociatedcosts.OG&E
estimatesthetotalcapitalcostassociatedwithitsenvironmental
complianceplantobeapproximately$1.1billion.TheOCChearing
onOG&E’sapplicationbeforeanALJbeganonMarch3,2015and
concludedonApril8,2015.Multiplepartiesadvocatingavarietyof
positionsintervenedintheproceeding.
OnJune8,2015theALJissuedhisreportonOG&E’sapplication.
WhiletheALJinhisreportagreedthattheinstallationofdryscrubbers
atSoonerUnits1and2andtheconversionofMuskogeeUnits4and5
tonaturalgaspursuanttoOG&E’sECPisthebestapproach,theALJ’s
reportincludedseveralrecommendations.OG&Efiled xceptionsto
theALJ’sreportandonJuly21,2015,CommissionerBobAnthony
issuedhisdeliberationstatementthatwasconsistentwithmanyparts
oftheALJ’sreport,includingtheALJ’ssupportofOG&E’sECP,the
ALJ’srecommendationtopre-approvecertainestimatedcostsofthe
environmentalrecoveryplan,andtheALJ’srecommendationtodefer
allothercostrecoveryissuesuntilthenextgeneralratecase.
OnDecember2,2015,OG&EreceivedanorderfromtheOCC
denying,byatwotoonevote,itsplantocomplywiththeenvironmental
mandatesoftheFederalCleanAirAct,RegionalHazeandMATS.The
OCCalsodeniedOG&E’srequestforpre-approvalofitsMustang
ModernizationPlan,reviseddepreciationratesforboththeretirement
oftheMustangunitsandthereplacementcombustionturbinesand
pre-approvalofearlyretirementandreplacementofgeneratingunitsat
itsMustangsite,includingcostrecoverythrougharider.
OnDecember11,2015,OG&Efiledamotionrequestingmodificati
oftheOCCorderforthepurposesofapprovingonlytheECP.OG&E
didnotseekmodificationtoa yotherprovisionsoftheOCCorder,
includingcostrecovery.OG&Ealsoagreedthatitwouldnotimplement
ariderforrecoveryofthecostsoftheECPuntilandunlessauthorized
bytheOCCinasubsequentproceeding.OnDecember23,2015,the
OCCrejected,byatwotoonevote,aproposalbyCommissionerDana
MurphytograntOG&E’sDecember11,2015motion.
