ofthefirst5percentoftheemployees’contribution.New
planparticipantsvest100percentinFCX’sandFMServices
Company’smatchingcontributionsuponthreeyearsofservice.
During2000,FCXandFMServicesCompanyalsoestablished
additionaldefinedcontributionplansforsubstantiallyall
theiremployeesfollowingtheirdecisiontoterminatetheir
definedbenefitpensionplans.Undertheseplans,FCX
andFMServicesCompanycontributeamountstoindividual
accountstotalingeither4percentor10percentofeach
employee’spay,dependingonacombinationofeachemployee’s
ageandyearsofservice.Thecostschargedtooperations
forFCX’sandFMServicesCompany’semployeesavingsplans
anddefinedcontributionplanstotaled$3.2millionin2005,
$3.2millionin2004and$2.8millionin2003.FCXandFM
ServicesCompanyhaveotheremployeebenefitplans,
certainofwhicharerelatedtoFCX’sperformance,whichcosts
arerecognizedcurrentlyingeneralandadministrative
expense.AtlanticCopperhasadefinedcontributionplanand
recordedchargestotaling$0.4millionin2005,$0.5millionin
2004and$0.4millionin2003forannualservicecostsrelated
tothisplan.
During2004,AtlanticCopperundertookacostreduction
andoperationalenhancementplandesignedtoreduce
unitcosts,includingareductioninworkforce,andenhance
operationalandadministrativeefficiencies.Inconnection
withimplementingthiscostreductionandoperational
enhancementplan,AtlanticCoppersubmittedaworkforce
reductionplantotheSpanishLabourAuthorityand,in
December2004,receivedapprovalforthisworkforcereduction
plan.AtlanticCopperrecordeda$12.0millioncharge
in2004relatedtotheworkforcereductionunderthisplan.
Thesechargesinclude$8.1millioninone-timetermination
benefitsforthoseaffectedemployeeseligibleforearly
retirementbenefits,$0.8millioninseverancepaymentsfor
thoseaffectedemployeesnoteligibleforearlyretirement
and$3.1millionforcontractterminationcosts.AtlanticCopper
paid$1.4millionofthesebenefitsinDecember2004and
paidthebalanceinthefirsthalfof2005.
Note10.COMMITMENTSANDCONTINGENCIES
GrasbergOpen-PitSlippageEvents.OnOctober9,2003,a
slippageofmaterialoccurredinasectionoftheGrasberg
openpit,resultingineightfatalities.OnDecember12,2003,
adebrisflowinvolvingarelativelysmallamountofloose
materialoccurredinthesamesectionoftheopenpitresulting
inonlyminorpropertydamage.Allmaterialinvolvedinthe
affectedminingareashasbeenremoved.Theeventscaused
PTFreeportIndonesiatoalteritsshort-termminesequencing
plansandtofocusitsopen-pitoperationsonaccelerating
theremovalofoverburdenfromthesouthwalltorestoresafe
accesstohigh-gradeoreareasinthepit.InApril2004,
PTFreeportIndonesiaestablishedsafeaccessandinitiated
mininginhigher-gradeoreareaswhilecontinuingoverburden
removalactivities.WhilePTFreeportIndonesiaresumed
normalmillingratesinJune2004,noassurancecanbegiven
thatsimilareventswillnotoccurinthefuture.
Asaresultofthefourth-quarter2003slippageanddebrisflow
events,PTFreeportIndonesianotifieditscopperconcentrate
customersthatitwasdeclaringforcemajeureundertheterms
ofitscontractsasitwouldbeunabletosatisfyitsannualsales
anddeliverycommitments.InDecember2004,PTFreeport
Indonesiaterminatedtheforcemajeurethathadbeenin
effectsinceDecember2003underitsconcentratesalescontracts.
PTFreeportIndonesiamaintainspropertydamageand
businessinterruptioninsurancerelatedtoitsoperations.
FCXanditsinsurersenteredintoaninsurancesettlement
agreementinDecember2004(SettlementAgreement).
UndertheSettlementAgreement,allclaimsthatarosefrom
thefourth-quarter2003slippageanddebrisfloweventsin
theGrasbergopen-pitmineweresettled.Theinsurersagreed
topayanaggregateof$125.0millioninconnectionwith
itsclaims.In2004,theinsurerspaid$94.5millionandthe
remaining$30.5millionwaspaidinJanuary2005.After
consideringitsjointventurepartner’sinterestintheproceeds,
PTFreeportIndonesia’sjointventureshareofproceeds
totaled$95.0million.Asaresultofthesettlement,FCX
recordedan$87.0milliongainoninsurancesettlement
forthebusinessinterruptionrecoveryandan$8.0million
gaintoproductioncostsforthepropertylossrecovery
foranetgainof$48.8million,aftertaxesandminority
interestsharing,in2004.
Environmental,ReclamationandMineClosure.FCXhas
anenvironmentalpolicycommittingitnotonlytocompliance
withfederal,stateandlocalenvironmentalstatutesand
regulations,butalsotocontinuousimprovementofits
environmentalperformanceateveryoperationalsite.FCX
believesthatitsoperationsarebeingconductedpursuant
toapplicablepermitsandareincomplianceinallmaterial
respectswithapplicableenvironmentallaws,rulesand
