and$466.0millionatDecember31,2003)asthesewould
onlybeusedshouldFCXberequiredtopayregularU.S.
tax,whichisconsideredunlikelyfortheforeseeablefuture
andbecausetheforeigntaxcreditsexpireaftertenyears.
AtlanticCopperissubjecttotaxationinSpainandhasnot
generatedsignificanttaxableincomeinrecentyears.FCX
hasprovidedavaluationallowanceequaltothefuturetax
benefitsresultingfromAtlanticCopper’snetoperating
lossestotaling$423.8millionatDecember31,2004,and
$282.6millionatDecember31,2003,whichexpirethrough
theyear2019.
PTFreeportIndonesia’sIndonesianincometaxreturns
priorto2000havebeenauditedorarenolongersubjectto
reviewbytheIndonesiantaxauthorities.FCX’sprovision

Employee Benefits
PT Smelting.PTSmelting,anIndonesiancompany,operates
asmelter/refineryinGresik,Indonesia.In2004,PTSmelting
increaseditsstatedproductioncapacityof200,000metric
tonsofcoppermetalperyearto250,000metrictons.
PTFreeportIndonesia,MitsubishiMaterialsCorporation
(MitsubishiMaterials),MitsubishiCorporation(Mitsubishi)
andNipponMining&MetalsCo.,Ltd.(Nippon)own25
percent,60.5percent,9.5percentand5percent,respectively,
oftheoutstandingPTSmeltingcommonstock.PTFreeport
IndonesiaprovidesnearlyallofPTSmelting’scopper
concentraterequirements.UnderthePTSmeltingcontract,
forthefirst15yearsofPTSmelting’scommercialopera-
tionsbeginningDecember1998,thetreatmentandrefining
chargesonthemajorityoftheconcentratePTFreeport
Indonesiaprovideswillnotfallbelowspecifiedminimum
rates,subjecttorenegotiationin2008.Theratewas$0.23
perpoundduringtheperiodfromthecommencementof
PTSmelting’soperationsin1998untilApril2004,whenit
declinedtoaminimumof$0.21perpound.InDecember
2003,PTSmelting’sshareholderagreementwasamendedto
eliminatePTFreeportIndonesia’sassignmentofitsearnings
inPTSmeltingtosupporta13percentcumulativeannual
returntoMitsubishiMaterials,MitsubishiandNipponfor
