Spousal consent is not required, however, if the Participant establishes to the satisfaction of the plan representative
that the consent of the spouse cannot be obtained because there is no spouse or the spouse cannot be located. A
spouse’s consent under this paragraph shall not be valid with respect to any other spouse. A Participant may revoke
a prior election without the consent of the spouse. Any new election will require a new spousal consent, unless the
consent of the spouse expressly permits such election by the Participant without further consent by the spouse. A
spouse’s consent may be revoked at any time within the Participant’s election period.
SECTION 6.04—NOTICE REQUIREMENTS.
Optional Forms of Retirement Benefit and Right to Defer. The Plan Administrator shall furnish to the Participant a written
explanation of the optional forms of retirement benefit in the OPTIONAL FORMS OF DISTRIBUTION SECTION of this article,
including the material features and relative values of these options, in a manner that would satisfy the notice requirements of Code
Section 417(a)(3) and the right of the Participant to defer distribution until the benefit is no longer immediately distributable.
The Plan Administrator shall furnish the written explanation by a method reasonably calculated to reach the attention of the
Participant no less than 30 days, and no more than 90 days, before the Annuity Starting Date.
However, distribution may begin less than 30 days after the notice described in this subparagraph is given, provided the Plan
Administrator clearly informs the Participant that he has a right to a period of at least 30 days after receiving the notice to consider the
decision of whether or not to elect a distribution (and if applicable, a particular distribution option), and the Participant, after
receiving the notice, affirmatively elects a distribution.
