Contingent Liabilities
We estimate the amount of potential exposure we may have with respect to claims, assessments and
litigation in accordance with accounting principles generally accepted in the United States. We are party to
pending or threatened legal proceedings covering a wide range of matters in various jurisdictions. It is difficult to
predict the outcome of litigation, as it is subject to many uncertainties. Additionally, it is not always possible for
management to make a meaningful estimate of the potential loss or range of loss associated with such
contingencies.

For the years ended December 31, 2011 and 2009, non-cash activities included proceeds from tax-exempt
borrowings, net of principal payments made directly from trust funds, of $100 million and $105 million,
respectively. During the year ended December 31, 2010, we did not have any tax-exempt borrowings; however,
we did have a $215 million non-cash increase in our debt obligations as a result of the issuance of a note payable
in return for a noncontrolling interest in a limited liability company established to invest in and manage
low-income housing properties. This investment is discussed in detail in Note 9. Non-cash investing and
financing activities are excluded from the Consolidated Statements of Cash Flows.
