On December 24, 2009, COA Network, Inc. (“COA”)
filed a complaint in the United States District Court for the District of New
Jersey, seeking declaratory judgment of non-infringement, invalidity and unenforceability of several of j2 Global’
s patents. On March 3, 2010,
the Company filed an answer to the complaint and counterclaims asserting that COA infringes two of the Company’
s patents. Also on March 3,
2010, j2 Global moved to transfer the case to the United States District Court for the Central District of California, or in the alternative to stay
the case. On June 17, 2010 the Court granted the Company’
s motion, transferring the case to the Central District of California. The case was
dismissed without prejudice on January 24, 2012.
On February 22, 2012, EC Data Systems, Inc. (“EC Data”) filed a complaint against the Company and one of its affiliates in the United
District Court for the District of Colorado, seeking declaratory judgment of non-infringement of U.S. Patent Nos. 6,208,638 and 6,350,066. The
Company and its affiliate have not yet filed an answer to the complaint.
