reflected in these tables.
8This number reflects legal proceedings initiated during the three and twelve month periods ended December 31, 2010 which remain pending before
the Federal Mine Safety and Health Review Commission (“Commission”) as of December 31, 2010. The Commission has jurisdiction to hear not
only challenges to citations, orders, and penalties but also certain complaints by miners. The number of “pending legal actions” reported here
pursuant to Section 1503(a)(3) of the Dodd-Frank Act reflects the number of contested citations, orders, penalties or complaints for which the
Commission has assigned a docket number and which remain pending as of December 31, 2010.
