Note 12—Employee Benefit Plan:
In April 2000, the Company adopted the NETGEAR 401(k) Plan to which employees may contribute up to 100% of salary subject to the
legal maximum. Through December 31, 2007, the Company contributed an amount equal to 50% of the employee contributions up to a
maximum of $1,500 per calendar year per employee. Beginning on January 1, 2008 through December 31, 2008, the Company contributed an
amount equal to 100% of the employee contributions up to a maximum of $7,000 per calendar year per employee. Beginning on January 1, 2009
for the first three pay periods of 2009 only, which ended on January 30, 2009, the Company contributed an amount equal to 100% of the
employee contributions up to a maximum of $7,000, for employees that remained active with the company through December 31, 2009. The
Company expensed $508,000, $1.3 million and $698,000 related to the NETGEAR 401(k) Plan in the years ended December 31, 2009, 2008 and
2007, respectively.

The Company adopted updated authoritative guidance for fair value measurements and disclosures effective January 1, 2008 for financial
